Advance Pricing Agreements — worth pursuing, or is standard TP documentation enough?
I heard you can agree pricing with the tax authority in advance — does that actually beat regular TP documentation?
An Advance Pricing Agreement (APA) is an agreement you reach with the tax authority in advance, setting the pricing methodology for a specific transaction — or set of transactions — between you and a related party (such as a sister company or a branch in another country), for a defined period going forward. Instead of filing your return and then finding out what the authority thinks of your approach after the fact, you agree on the methodology upfront, and as long as you stick to it, that transaction is protected from being re-assessed later.
In the UAE, the APA route is now formally available as part of the transfer pricing framework, giving businesses with large or complex related-party transactions an official channel to get advance confirmation, instead of relying purely on their own internal judgment and waiting years to find out the authority's view.
But the practical question is: does every business need one? No. An APA is worth the effort where transactions are high-value, recurring, and complex — such as an intellectual property transfer, or centralized management services shared across a large group in more than one country — where getting the methodology wrong could be genuinely costly. For small and mid-sized businesses whose related-party transactions are limited or straightforward, standard transfer pricing documentation (a Local File and Master File, where your size requires them) is entirely sufficient, and pursuing an APA would just be more effort than the situation actually calls for.
